Mexico. The Investigating Authority of the Federal Institute of Telecommunications, IFT, made available to the public the Electronic System for Filing Complaints with the Investigating Authority, SEPDAI, as an alternative means to denounce the probable commission of anti-competitive conduct prohibited by the Federal Law on Economic Competition, LFCE.
SEPDAI is provided for in the Guidelines for the submission of complaints of monopolistic practices and illegal concentrations in the telecommunications and broadcasting sectors, before the Investigating Authority of the Federal Institute of Telecommunications, through electronic means, published in the Official Gazette of the Federation on December 10, 2018.
The use of SEPDAI is optional and is established with the purpose of facilitating that any natural or legal person can denounce through the Internet the probable existence of monopolistic practices and illicit concentrations making use of information and communication technologies.
The SEPDAI may be used from the moment of filing the complaint and until the issuance of the agreement that orders the initiation of the investigation, dismisses the complaint as notoriously inadmissible or considers it not presented, as appropriate.
In accordance with the Guidelines, a complaint may be submitted through SEPDAI at any time, after registration in that system. The complaint may be submitted in writing; or, by filling out the form available for this purpose in the SEPDAI, as long as the requirements established in article 68 of the LFCE are met.
