Peru. The Ministry of Transport and Communications, MTC, ordered the start of the reorganization of the 3.5 GHz band (3400 – 3600 MHz), so that users have higher connectivity and navigation speeds, according to the new technologies that are implemented, including those related to the deployment of 5G networks and services.
This was established by Directorial Resolution No. 358-2019-MTC/27 of the MTC, which, in addition, provides for adapting the aforementioned band to the new channeling at 3300 – 3800 MHz.
Currently, there are four operators that have spectrum in this band and provide Internet and wireless fixed telephony services.
"The spectrum will be reassigned with priority to the user and in an environment of fair and free competition in accordance with the Specific Regulations for the Reorganization of a frequency band," said the General Director of Communications Programs and Projects of the MTC, Nadia Villegas.
Like the recent completed reordering of the 2.3 GHz and 2.5 GHz bands, the process initiated will include proposals that will take into account the comments of interested parties, what is worked on in meetings with the operators involved and what is related in the future public hearing.
In addition, "this process will lead to new coverage commitments that will benefit localities of preferential social interest and will free up spectrum that will be the subject of future public tenders. It is estimated to finish the reorganization process, in the second quarter of 2020, "said the official.
It should be noted that mobile operators carry out tests for the application of 5G technology in the 3.5 GHz band, thanks to the temporary frequency allocations granted by the MTC; as part of the initiatives taken for the deployment of new technologies for the benefit of consumers.
Protection of personal data
Ministerial Resolution No. 978-2019-MTC/01.03 was also published, which reinforces control and monitoring so that operators comply with their commitments and at the same time they are facilitated the way to reduce penalties, through the deployment of infrastructure to generate more and better services.
The publication establishes the criteria to measure the general performance of the concessionaire companies with respect to the fulfillment of their contractual and regulatory obligations, with the aim of calculating the term that will be granted at the time of requesting the renewal of their concession contract.
The proposal includes the observation of the behavior regarding the protection of personal data, based on the sanctions imposed on the subject by the National Authority for the Protection of Personal Data.
The proposal will be available for comments from the general public for 30 calendar days for all kinds of suggestions or observations.
