Colombia. The CRC published the "Preliminary Consultation on Infrastructure Sharing of Other Services in the Provision of Telecommunications Services".
This consultation is addressed to all providers of telecommunications networks and services, operators of broadcast free-to-air television, subscription television, organized communities providing the community television service, and providers of the sound broadcasting service in order to obtain preliminary information on the current situation of the sharing of infrastructures in other sectors that serve for the deployment of networks of telecommunications.
The recently issued Law 1978 of 2019 or Law of Modernization of the ICT Sector established at the head of the CRC the responsibility of defining the conditions of access to poles, pipelines and passive infrastructure that can be used in the provision of telecommunications networks and services under a cost-efficient scheme. For the purposes of the above, the new law indicates that the CRC must issue a new regulation within a maximum period of six (6) months, after preparing a technical study where the following will be analyzed:
- Pricing schemes.
- Load capacity conditions of the poles.
- Physical capacity of the pipeline.
- Occupation required for sharing.
- Use made by the owner of the infrastructure.
- Definition of rules for the division of the value of the consideration by the number of operators that can make use of the infrastructure, according to the technical capacity of the pole and the physics of the pipeline, as defined by the CRC.
Taking into account the deadline established in the law, the CRC has endeavored to collect early relevant information on the different problems and challenges that generally involve the sharing of infrastructure of other sectors through the completion of a form prepared for this purpose, which must be sent to the CRC through the email address [email protected] before September 5, 2019.
