Mexico. The Federal Institute of Telecommunications, IFT, imposed a sanction in the amount of 5 million 383 thousand 200 Mexican pesos, derived from the administrative procedure instructed against Telmex for non-compliance with the third paragraph of Condition 1.9 of its concession title.
The entity imposed this sanction considering that, between November 2008 and August 2014, that company entered into a contract with Dish México, S.A. de C.V. and its subsidiaries and affiliates, forming a complex contractual system that allowed Telmex to influence or influence the operation and exercise of the rights derived from the concession granted to Comercializadora de Frecuencias Satelitales, S. de R.L. de C.V. to provide the service of restricted television via satellite (DTH) in the country.
In view of this, it was considered that that company indirectly exploited a concession for television services, which is expressly prohibited in terms of the third paragraph of condition 1.9 of its Concession Title.
It should be noted that the sanction was imposed because the conduct that was considered contrary to its concession title ceased in its effects before the entry into force of the Federal Law on Telecommunications and Broadcasting, in accordance with the evidentiary documents in the respective file.
