Peru. The Ministry of Transport and Communications is authorized to suspend the outgoing traffic of the telecommunications service of telephone lines from which malicious calls are made to emergency, emergency and information centers. The penalty will be for 30 days.
For the procedure of suspension of the communications service, the emergency, emergency and information centers will issue a daily report to the MTC detailing the telephone lines from which they received the malicious calls (jokes, asking questions that have nothing to do with the guidance offered or disrespect the operators).
Once the MTC receives the report, it will request the concessionaires of the public telecommunications services to suspend the outgoing voice and data traffic for a period of 30 calendar days.
The provision is part of the new actions that the Executive will implement in the face of coronavirus cases in the country. The rule is detailed in Article No. 13 of Emergency Decree No. 026-2020.
"They dictate complementary measures aimed at strengthening the surveillance and health response system against Covid-19 in the national territory and reducing its impact on the Peruvian economy."
"Public service concessionaires have the obligation to carry out the temporary suspension within a maximum period of 24 hours of receiving the suspension request," according to the rule.
It is added that failure to comply with this obligation constitutes a very serious infraction and punishable by fines included in the Single Ordered Text of the Telecommunications Law. For the purposes of this provision, the centers of attention of the National Institute of Civil Defense (Indeci) are considered emergency, urgency and information centers.
The measure will be executed for the duration of the period of Declaration of Health Emergency established in Supreme Decree No. 008-2020-SA.
