MTC modified frequency register, affected claim

Peru. Concern, surprise and complaints generated the elimination of radio and television stations from the National Frequency Registry by the Ministry of Transport and Communications (MTC). All stations that were in the process of cancellation and challenge were deleted from the system where the owners authorized to provide the broadcasting services appear.

For years, several of these stations remained in the Frequency Registry with the observation "canceled / contested", however, at the beginning of March, this information began to be purged in order not to create distortion.

"This action was carried out in coordination with the MtC Attorney General's Office, the General Directorate of Authorizations in Telecommunications and the General Directorate of Control and Supervision in Communications, taking into account that these authorizations were canceled. And while it is true that they are contested, it does not mean that they are in force, unless you have a precautionary measure," said ERM sources.

It should be noted that all stations canceled or not renewed their authorization, can only continue to operate as long as the challenges or claims are made administratively. Once this instance is exhausted, the station has to stop operating or else it will be considered an illegal (pirate) station; unless you have a precautionary measure from the judiciary. The fact that you have an administrative contentious lawsuit, on its own, does not have the right to continue operating.

For their part, the broadcasters affected by this measure complained that, while the process is not concluded and it is not "res judicata and consented" the MTC should not eliminate them from its database, since the negative resolution of the MTC is challenged either in administrative or judicial proceedings.

"The decisions of the MTC are not infallible, many times the stations are canceled wrongly or due to errors of the administration, it is not right to be eliminated from the frequency register, because that harms the trajectory and image of our company. Because in the end the court ends up correcting the MTC and returning our frequencies," said an affected broadcaster.
