Mexico. The Plenary of the Federal Institute of Telecommunications, IFT, resolved to impose two economic sanctions on the company Televisión Internacional, S.A. de C.V., two on the company Mega Cable, S.A. de C.V., and one on the company CV Telecomunicaciones del Norte, S.A. de C.V., derived from different administrative procedures initiated for non-compliance with provisions established in the Guidelines for the retransmission of broadcast signals and Federal Public Institutions, in different cities of the country.
In all cases, the IFT was able to prove, first through verification visits and then through the corresponding administrative procedures, that the companies indicated did not retransmit different television channels to which they were obliged as concessionaires of restricted television, in accordance with the provisions of the Institute's guidelines. Channel 11.2 Eleven Children of the National Polytechnic Institute (IPN) was one of those that was not broadcast.
Channel 11.2 Eleven Children of the IPN is part of the signals of the Federal Public Institutions that the IFT published in the Official Gazette of the Federation as available to be retransmitted by the concessionaires of restricted terrestrial television, based on what is indicated in article 12 of the Guidelines for retransmission of signals.
Although the signal of channel 11.2 is not broadcast in some cities, the concessionaires are obliged to transmit them because they are in the list previously prepared and published by the Institute.
In the case of Televisión Internacional (TVI), the Institute proved that it did not retransmit simultaneously, in its entirety and without modifications different signals to which it was obliged both in the city of Monterrey and in Sabinas Hidalgo, both in the State of Nuevo León.
In Sabinas Hidalgo, TVI did not retransmit the signal of the broadcast channel 43, with XHFN call sign, and DTT band and commercial name 7.1 HD-Azteca 7, of another broadcast television concessionaire with presence in the same coverage area; nor did it retransmit the signals of the Federal Public Institutions corresponding to "TV UNAM", "Canal 30 Una Voz con Todos", "Ingenio TV" and the multi-programmed channel 11.2 Once Niños.
In Monterrey, and based on another administrative procedure carried out, the IFT proved that TVI did not retransmit the signal of channel 11.2 Once Niños, of the IPN.
Therefore, the PLENARY of the IFT resolved that TVI is entitled to two fines, each of $31'104,326.66 (thirty-one million one hundred and four thousand three hundred and twenty-six pesos 66/100 M.N., in terms of the same article 298. Each corresponds to 1% of the company's accumulated revenue in 2014.
