Mexico. A federal court granted Teléfonos de México (Telmex) an injunction that goes against the decision of the Ministry of Communications and Transportation (SCT) not to modify the concession title, which prevents the company from having access to the television market.
The sixth judge of the District in administrative matters in Mexico City, Jéssica Villafuerte Alemán, granted the amparo to Telmex so that the head of the SCT, Dionisio Pérez-Jácome, issues a new resolution in which he must rule exclusively on whether or not to modify the concession title of the telephone company.
The judge determined that the SCT did not take into account all the information in the case and now the government would have to review Telmex's request to issue a decision again.
The SCT said it did not allow Telmex to change its concession title because the company was not complying with conditions on interconnection to rivals under a convergence agreement between the government and operators.
Consequently, the SCT will have less than a week to challenge the judgment through an appeal for review, which must be resolved by the Seventh Collegiate Court, which ruled that Telmex has the favorable opinion of compliance with requirements to modify its concession title.
