Colombia. The ICT Ministry issued Resolution 03556, which establishes the rules for the allocation and execution of resources from the Single Fund for Information and Communication Technologies (FUTIC) aimed at strengthening public television and radio, including national and regional operators.
Based on this resolution, which updates Law 1341 of 2009, which establishes the rules for the allocation and execution of resources to support the country's public media, the lines of investment, the criteria for the distribution of resources, the deadlines for the execution of projects, the obligations of the beneficiaries and the mechanisms for reporting are clearly defined. The aim is to ensure that resources are used efficiently and transparently to promote access to information, culture and education through public media.
With this update, you are mainly looking for:
Unify and update the regulation of the functions of the FUTIC: The resolution seeks to integrate the existing rules and avoid regulatory dispersion, unifying the regulation of the functions of the FUTIC described in numerals 3, 4, 9, 10, 16, 17, 18, 19 and 21 of Article 35 of Law 1341 of 2009, and Article 45 of Law 1978 of 2019.
Specify the allocation of resources to RTVC: It aims to clarify the value assigned to RTVC according to paragraph 3 of article 34 of Law 1341 of 2009 and how this budget is adjusted annually with the Consumer Price Index (CPI).
Clarify copyright management: The idea is to specify that the authorization to use the works financed with the FUTIC is for five years, and to establish periods of exclusivity for the public communication and reproduction of the works, so that the public operators that produce them can exploit them initially, without the need to grant authorizations to others.
Detail the distribution of resources to regional operators: The aim is to clarify the variables of the resource distribution formula (Promotion of Industry, Financial Sustainability) and establish that the variable "Audience" will be calculated based on the average of the previous term.
Define the co-financing of the Institutional Channel: It is specified that the co-financing of the programming of the Institutional Channel will be 50% by the FUTIC and the remaining 50% by the participating national entities.
Unify the rules for the transfer of resources: The aim is to unify the rules for transfers to national and regional television operators, avoiding differences and ambiguities.
Specify the competence in the evaluation of projects: It is clearly established that the coordinator of the Internal Working Group for the Strengthening of the Public Media System is responsible for evaluating projects with direct assignment and through competitions, including those related to sound broadcasting.
Through this update, the ICT Ministry seeks a more efficient, transparent and equitable management of FUTIC resources, with clear rules for their allocation, execution and control, and a focus on strengthening public television and radio, promoting content of public interest and access to ICTs.
