Colombia. After the entry into force of the law on modernization of the Information and Communications Technologies sector -Law 1978 of 2019-, the ICT Ministry published for comments the draft decree that establishes the process for the selection of the commissioners who will be part of the single regulator, that is, the Communications Regulation Commission, CRC.
This law created the single and independent regulator with the aim of putting the institutionality of the sector in the international standard and established that it will have two sessions, one of Audiovisual Content and another of Communications. The draft decree establishes the general procedure for public tenders in order to choose the commissioners of each of the sessions.
The Audiovisual Content session will be composed of three commissioners: one elected autonomously by the regional public television operators and two elected through a public tender, one representing civil society and the other the audiovisual sector. This process will be carried out by a public or private university that will be selected by the Ministry of National Education.
For its part, the Communications session will be composed of MinTIC, a commissioner appointed by the president and three commissioners elected through a public tender advanced by the Administrative Department of the Public Function.
The draft decree establishes that, for public tenders, there will be three stages: call, recruitment and tests, which includes a knowledge test that will have a minimum value of 60% of the total; a test assessing work skills, the value of which may not be less than 20% of the total; an assessment of studies and experience, and an interview.
