Antennas in green areas should be mimicked

Peru. In order for the telecommunications infrastructure to be installed in an orderly manner, the Ministry of Transport and Communications, MTC, established more demanding parameters such as the "tree-type" mimicry for the case of antennas to be deployed in parks and squares located in urban and rural areas.

Thus, Decree No. 004-2019-MTC was published, which modifies various articles and Annex 2 of the Regulation of Law No. 29022, Law for the Strengthening of the Expansion of Infrastructure in Telecommunications, approved by Supreme Decree No. 003-2015-MTC, which also specifies that only one antenna may be installed per park or square.

It should be remembered that the MTC does not grant permits for the installation of antennas, this corresponds to a procedure under the automatic approval mechanism, whose files -with the complete documentation- are presented at the windows of each corresponding municipality, without prejudice to the subsequent inspection that can be carried out by each entity, in matters within its competence.

In this sense, the municipalities have under their competence to sanction the breaches related to the installation of telecommunications infrastructure without having the respective permits, in case of presentation of false documentation, if the companies do not maintain in good condition the installed antennas, among others.

Likewise, sanctions are established in case passive infrastructure providers fail to comply with the schedule of works or do not report the completion of the installation of the antennas to the competent authorities.

Additionally, in recent years it has been identified that the measurements made to telecommunications companies are well below the maximum permissible limits. This allows the State to reduce the obligation of operators to carry out annual measurements and to present it, without prejudice to the supervision carried out by the competent entities and to provide the information whenever the MTC deems it necessary.

In this way, we highlight the importance of modifying the current guidelines, incorporating infrastructure models with less visual impact, which helps minimize the negative perception that citizens have towards the deployment of telecommunications infrastructure.
