Peru prohibits sale or rental of Pay-TV set-top boxes

Peru. The Supervisory Body for Private Investment in Telecommunications, OSIPTEL, approved the elimination of the sale or rental of decoders in the Pay TELEVISION service, considering that these equipment are essential to enjoy the service and are part of the operator's network.

In this way, the contracting of this service will include a decoder at each contracted point, without the user having to rent or buy them separately.

The provision is part of the "Rules for the Provision of the Pay Television Service", which are aimed at ordering the tariff concepts for that service, in the prepaid and postpaid modalities, in order to facilitate the comparison between the rates offered by the operating companies, and, in this way, raise the competitive intensity.

Thus, the following concepts are established such as: (i) Access Fee, which will be applied only once when contracting the service, and includes the installation and / or activation of the same; (ii) Usage Fee, which will be applied for keeping the service active and will include the authorization of an access point at least for the provision of the service; and, (iii) Rate per Additional Service Point, which will be applied for the authorization of each additional point requested by the subscriber, within the framework of the same service contract. It should be noted that these charges currently exist, and are only being grouped into three concepts.

"With these rules, greater transparency and simplicity in the contracting and collection of the service is guaranteed, and adequate conditions are promoted for a greater competitive intensity in the pay television market," said the President of the Board of Directors of OSIPTEL, Rafael Muente Schwarz.

In case of prepaid Pay-TV service
It will be considered that the contracting of the Pay TELEVISION service in the prepaid mode will be effective when the user requests the activation of the service.

In these cases, the only payment made by a user through the distribution channels of the operating company will be considered as the Access Fee.

Financing of payment per installation will not be greater than 6 months
Likewise, OSIPTEL provided that the financing of the payment for installation or access in public telecommunications services, as well as the additional contracts that are concluded for the acquisition of terminal equipment, cannot imply the payment of fees for periods exceeding six months, with the exception of the mobile public service.
