Argentina. The Board of Directors of the National Communications Agency, Enacom, approved the Regulation for the Registration of ICT Services - Value-Added Services, Internet Access through Resolution No. 2483/2016. Given the existence of numerous providers and the substantial increase in access to this service that has occurred in recent times, the measure simplifies the procedures for obtaining licenses and registering these services.
The Regulation of Registration of ICT Services – Value Added Services, Internet Access aims to establish the principles that will govern the registration, cancellation or modification of the Registry of ICT Services (RESTIC) by anyone interested in providing Value Added Services - Internet Access to third parties.
The new provision promotes the development not only of the telecommunications market, but also technological advances and new alternatives that providers can offer to users of ICT services, in a context of permanent technological evolution.
The standard requires that, prior to registration in the RESTIC, providers must have the enabling license for the provision of the Value Added Service - Internet Access, in accordance with the terms and requirements determined in the regulations.
In this sense, it provides that registration in the RESTIC implies the granting of a Single Argentine Digital License in case of not having it. On the other hand, it establishes that, if the provider of the Value Added Service - Internet Access chooses in the future to provide another ICT Service, it must process and comply with the requirements established in the current regulatory framework and its complementary and / or amending rules.
Finally, the regulation establishes a series of obligations that the providers of this service must comply with, as well as the applicable sanctioning regime.
