Peru. Due to the increase in demand for the radio spectrum originated in recent years, the Ministry of Transport and Communications, MTC, ordered the lease of frequency bands with the aim of optimizing the use and exploitation of this scarce resource.
Through Supreme Decree No. 015-2019-MTC, the norm that regulates the lease of radio spectrum frequency bands for the provision of public telecommunications services is approved.
"This figure is a mechanism that allows you to rent, temporarily, part of the frequencies that a company has assigned. It means that, if one operator does not use them to their full capacity, another can request the lease, give it greater value and thus offer new services, "explained the Deputy Minister of Communications of the MTC, Virginia Nakagawa.
This new standard will maximize the use of spectrum, improve and expand the offer of telecommunications services in the country. "Since 1998, it has taken 21 years to have a standard that allows to boost the use of the radio spectrum, fix distortions and establish a predictable, transparent procedure with objective criteria," Nakagawa added.
The application of the regulations will be subject to goals of use, coverage, improvement of services, free connectivity to entities in favor of the population, and will be mandatory for companies that do not present improvements in their indicators of spectrum use.
It also regulates the requirements, procedures, deadlines and conditions for the permit of the lease of frequencies, as well as for its modification and / or renewal, which aims to verify, in advance, compliance with the law and avoid possible situations that affect the market.
The lease will have a maximum validity of ten years, which can be renewable every five, after verification of compliance with obligations.
