Mexico. Following the decision of the Federal Institute of Telecommunications, IFT, to declare Televisa as an Economic Agent with substantial power in the Pay-TV service, the company rejected the decision arguing that its subscribers have fallen in recent months.
According to data made public by the company, the number of Televisa subscribers in Pay-TV have fallen from 64% to 57% of the total market, while its direct competitors have been growing. The company supports this data in its quarterly reports.
It should be recalled that on January 19, the First Collegiate Court in Administrative Matters Specialized in Economic Competition, Broadcasting and Telecommunications issued an enforcement ordering the revocation of the resolution of the Plenary of the Federal Institute of Telecommunications (IFT) issued on September 30, 2015 in its XXXIII extraordinary session, in which it determined that sufficient elements of conviction were not available to determine the existence of an Economic Agent with substantial power in the Pay-TV service.
Televisora del Valle de México filed an amparo against that resolution, which was denied in the first instance, so it filed an appeal for review that was resolved favorably by the First Court last January, granting the amparo.
Televisa described the IFT's resolution as unconstitutional and assured that it will analyze the 467 pages of it because it considers that it does not comply with the guidelines of the collegiate court.
