Argentina. Through a Resolution approved at the meeting of the Board of Directors of Enacom, the license of the audiovisual media service of sound broadcasting awarded to the firm DESUP SOCIEDAD ANÓNIMA, known as Radio América, was declared extinguished because it is incurring in the cause of extinction provided for in article 50, paragraph i) of Law No. 26,522.
Based on this, the specifications and conditions that will govern the public tender for the award of the license in relation to the installation, operation and operation of the sound broadcasting station by amplitude modulation in the frequency 1190 KHz identified with the LR9 Radio América signal, located in the Autonomous City of Buenos Aires, were approved.
It may be assigned to a natural person or person of ideal existence for profit constituted or in formation or non-profit constituted. The specifications, on the other hand, will be feasible to be acquired up to fifteen calendar days before the opening date of the public tender.
The reception and opening of the offers will be held on October 13, 2016 at the headquarters of Enacom, in a public act, before a Notary General of the Government of the Nation or delegated notarial professional. The acquisition of the tender was set at a value of 75,000 pesos ($75,000).
From this same resolution it was established that the firm in charge of Radio América must maintain the broadcast of the radio service until the new licensee regularly begins its activity on the frequency awarded.
According to Article 50 of Law 26,522 on Audiovisual Communication Services, licenses will be extinguished "for loss or non-compliance with the requirements for adjudication established herein, after compliance with summary with guarantee of right of defense". In this sense and within the framework of the inspection of the service, it was found that between February 12 and 16, 2016, the broadcast of the Radio America frequency was suspended.
Enacom proceeded to carry out a series of inspections and intimations to the representative of the license, DESUP SOCIEDAD ANÓNIMA, who stated that the transmitting plant had been taken over because of a union labor conflict, which prevented the normal issuance. From that point on, the service broadcast only music. For this reason, the conditions for declaring the termination of the license and, therefore, the corresponding call for public tender of the released frequency were verified.
