Peru. The Ministry of Transport and Communications, MTC, published the technical criteria and guidelines that telecommunications concessionaires should consider when requesting the temporary allocation of radio spectrum within the framework of the State of Emergency.
Among the measures, it is established that companies must prove the potential danger of affecting the quality or continuity of telecommunications services, in certain areas or localities due to the increase in traffic demand.
To this end, the concessionaires have to present various parameters, such as the percentages of the use of resources of each radio station where continuous problems of excess demand are registered during or as a result of the Health Emergency decreed at the national level by the existence of Covid-19.
They will also have to present a detailed description of the technical and operational characteristics of the system to be installed, which includes specifying the frequency band and bandwidth requested. Additionally, they must take into account that the service requested must correspond to the attribution of the band according to the National Frequency Allocation Plan.
"These criteria will streamline procedures and minimize possible observations, in accordance with the purpose of Legislative Decree No. 1478 that authorizes the temporary allocation of radio spectrum to concessionaires of public telecommunications services," said Nadia Villegas, General Director of Programs and Projects in Communications of the MTC.
It should be noted that applications are evaluated by the ERM, taking into account the availability of frequency bands and radio spectrum ceilings in force, with priority given to those that have greater relevance over telehealth and teleeducation.
The return of the radio spectrum by the concessionaires of public services carriers and final telecommunications is carried out unfailingly after the deadline, being their responsibility to ensure the quality and continuity of the services provided before the temporary assignment.
Improvement in service quality
According to legislative decree No. 1478, the MTC has the power to request that operating companies that have been temporarily assigned spectrum provide free internet access in a health facility or educational institution for each district where the temporary allocation is approved.
This temporary assignment is granted for a maximum period of up to six months, extendable for a single time up to the same period.
