Peru. The Ministry of Transport and Communications, MTC, works and analyzes in a technical way the illegal use of the so-called "IPTV" equipment used for online piracy, which harms the free market and consumers. Such a measure would generate an eventual restriction on their free importation, said the Deputy Minister of Communications, Virginia Nakagawa.
He pointed out that the communications sector safeguarded the misuse that was being provided through the devices called "FTA" that, after the restriction on their free importation, allowed to reduce the piracy that affected the pay-TV market and, above all, generated a great lack of protection for users.
In the current scenario, "IPTV" devices would be used to obtain benefits and advantages unfairly.
"At the same time that the regulations of protection of copyright are violated, taxes are evaded, anti-competitive advantages are generated harming legal companies, but above all the population is affected, which when acquiring these "IPTV" in the understanding that they acquire a service, are surprised since they do not have a claims procedure in case of quality failures, since they are pirate companies," Nakagawa Morales said.
The rapid advance of the development of the Internet also implies the diversification of the pirate offer. Web portals have opened the possibility of accessing free content to the detriment of the formal offer. In that sense, Nakagawa said that the focus of the MTC is to protect the user.
"Our vision is centralized action to the citizen, within clear and transparent rules. To that extent, we are concerned about these impacts on the rights of consumers," said the official.
Nakagawa argued that the MTC is evaluating declaring as grounds for termination of the concession contract for Pay-TV, those contracts whose owner companies had breached – by means of a resolution that qualifies as res judicata – with copyright.
"I consider it important that Indecopi can communicate to the MTC when the judicial proceedings are completed or when its administrative decisions have been consented, in the sense that infringements of copyright regulations have been configured in order to adopt the corresponding actions," he concluded.
The deputy minister inaugurated the "SUMMIT Antipiracy and Content Tour 2018", a forum that travels through the main cities of Latin America, with the aim of debating, informing and advancing in the fight against piracy, bringing together the main operators, programmers and authorities of the sector, to generate agreements in the fight against piracy.
