Colombia. According to UNESCO's Global Anti-Piracy Observatory, the term piracy includes the reproduction and distribution of copies of copyrighted works, as well as their transmission to the public, without the authorization of the rightful owners, when such authorization is legally necessary.
The word piracy automatically relates our notions with illegal acts, the National Television Authority – ANTV has established from the Constitutional point of view, a regulatory power and the sanctioning power of the administration whose normative purpose is to define operating frameworks and prevent the commission of infractions that threaten the integrity of the legal assets whose protection has been attributed by the legislator to the administrative authority.
Piracy in the sector is not a minor crime, on the contrary, it has two types of sanctions according to current regulations. One of an economic type and another of a criminal type, depending on the fraud.
Pirate or clandestine television is considered to be any unauthorized television service that operates radio frequencies without the prior assignment of the National Television Authority, ANTV. Likewise, the distribution or communication to the public of unauthorized signals in fraud of copyright or related rights (by illegal providers or authorized operators) is sanctioned.
Users with FTA devices, whose acronym stands for Free To Air:
This modality involves two types of devices, one that usually contains a card with a modified software capable of decrypting the codes of the official services and another that receives those illegal signals. Such devices alter technological protection measures by means of "Control Word Sharing" techniques, for example "cardsharing", "Internet Key Sharing", "Satellite Key Sharing" among others, capable of deciphering audiovisual signals by means of keys or downloadable codes of web pages or satellites arranged for this purpose.
User underreporting:
It translates into the altered presentation of information, about the reality of subscribers and subscriptions. The first evidence of these inconsistencies in the information is presented by the differences that are presented on the same subject between
different sources.
The underreporting of users and income, as well as the non-payment of copyright and taxes, affect the conditions of competition in the industry and limit the possibilities of investment and development of television in Colombia.
