Mexico. The Federal Telecommunications Institute initiated an investigation procedure in terms of the Federal Law on Economic Competition in order to determine the existence of economic agents with substantial power in the associated audio and video markets through public telecommunications networks with a national dimension, local, state and/or regional.
The foregoing on the understanding that the relevant market or markets will be determined at the appropriate procedural time in terms of the LFCE and the Regulatory Provisions, since this agreement refers only to the initiation of an investigation procedure of an administrative nature in which the markets have not yet been definitively identified (or the relevant market) that, where appropriate , will be established in terms of the provisions of the Federal Law on Economic Competition and the applicable Regulatory Provisions.
The entity indicated that the procedure should not be understood as a prejudgment on the existence of substantial power on the part of any economic operator, but of an action by the authority aimed at initiating the procedure provided for in Article 96 of the LFCE, in accordance with articles Thirty-Ninth Transitory and 264, first paragraph of the LFTR and, once this procedure has been concluded, the resolution that is legally appropriate will be issued.
In order that anyone can contribute during the investigation procedure, the entity disseminated an extract of the initiation agreement published in the Official Gazette of the Federation on September eleven, 2014.
