Peru. The Ministry of Transport and Communications, MTC, published the new regulation of control and sanction in the communications sector that aims to guarantee the correct functioning of radio, television and Internet services.
By Supreme Decree No. 028-2019 published in the official newspaper El Peruano, the MTC has, for the first time, a normative instrument that standardizes and systematizes the principles, rules and procedures applicable to the tasks of control and sanction in the communications sector.
The regulations ensure a predictable, transparent, efficient and modern work, with the use of information technologies, oriented to the particularities and characteristics of the activities of the sector, and adopts the highest standards in terms of control.
"The strategic planning of the supervisions, with a risk approach, will allow prioritizing the interventions of the authority towards those breaches, irregularities or interferences that generate harm to citizens," said the Deputy Minister of Communications, Virginia Nakagawa.
On the other hand, the signals of illegal radio stations (which generate interference in the different services) will be intervened through the use of technological devices that, located in strategic places, allow a greater radius of action and that are operated from the MTC data center, reducing the response times of the authority.
The regulation empowers the MTC to issue immediate measures to correct possible interference in radio, television and public telecommunications services (mobile telephony and internet) that affect the services received by users.
"Previously, there was a lack of coercive mechanisms to enforce the mandates of the authority. With this rule, non-compliance with corrective and precautionary measures has been classified as very serious infractions, which will ensure compliance with the mandates of the authority, "said the Deputy Minister of Communications.
The approved sanctioning procedure assures citizens and businesses of the right to due process, guaranteeing an adequate, technical and impartial assessment of the authority.
Citizens will be able to access permanently and free of charge the information of the infractions and sanctions imposed by the MTC, as well as the oral reports corresponding to the sanctioning procedures, making their work more transparent.
On the other hand, any citizen or company that is inspected will be able to verify before the start of the inspection the identity of the inspectors through the website of the MTC, which will avoid possible cases of impersonation, irregularities or situations that put the safety of people at risk.
