CRC consults elimination of 21% of existing regulation

Colombia. With the purpose of stimulating investment in infrastructure and services, the country's economic growth and the well-being of users, the CRC is advancing a project that seeks to simplify the regulatory framework through the elimination of disused standards and the definition of a roadmap that the Commission will follow to address the simplification process.

The total or partial elimination of some of the articles identified as candidates corresponds to criteria such as: whether they are transitory rules, if they are duplicated or if they are obsolete due to market evolution or technological evolution.

Taking into account these criteria, the Commission presents the preliminary list of regulatory prioritization, with the aim that interested agents participate and help identify the main problems, based on the associated compliance cost and the impact it generates, for the construction of the roadmap that the Commission will follow to address the process of simplification of the regulatory framework.

Additionally, it publishes the list of articles that are candidates for total or partial elimination due to disuse, which arose from the comments received from different agents, as well as from the preliminary review carried out by the Commission, and which will be analyzed in the regulatory proposal in which it is working.

The foregoing is part of the process of regulatory improvement in which the CRC has been working, and which is supported by four pillars: i) Regulatory Impact Analysis, which seeks to strengthen trust, effectiveness and transparency in the issuance of regulations, ii) Regulatory Agenda, which tends to define the regulatory activity of the CRC based on in-depth knowledge of the behavior of the industry and the results that iii) Knowledge of the Ecosystem, the CRC by reorganizing its structure with a broad approach to planning, leaves aside the traditional issues that arise in a traditional telecommunications environment seeking to address all problems with all possible points of view and iv) Regulatory simplification approach, seeks to simplify the regulatory framework to help encourage investment and increase competition.
  
Considering that the simplification of regulation is a fundamental pillar to support sectoral policy, an initiative aimed at simplifying the regulation of the CRC was included in the Regulatory Agenda 2018-2019, according to which the regulatory initiatives that are in progress will have a decision -when applicable- aimed at regulatory simplification and the revision of different parts of the regulation that have not been subject to modification in recent years, and that due to regulatory obsolescence they are not required

"To ensure that the relevant regulations are simplified, the CRC has contemplated joint, dynamic and multidisciplinary efforts in which the different agents of the sector participate, which ensures regulatory reforms in accordance with the reality of the market," explained Germán Darío Arias Pimienta, Executive Director of the CRC.

"In conclusion, this project focuses on eliminating bottlenecks that allow greater investments by operators, to boost competition and improve prices, which ultimately translates into greater benefits for users of communications services in the country," Arias concluded.
